A major lawsuit has being filed that's going to send shockwaves across Jordan-Hare and The Plains. We'll have the info around 12:30
That comes directly from the WJOX twitter page. Pretty much all of the bigger sites this morning have been abuzz with talk of former Auburn offensive lineman Chaz Ramsey filing a lawsuit against AU, presumably regarding his departure from the team. Obviously I don't know the specifics of all that went down, but as per this article, things got pretty ugly with his injury.
I'm not expecting much out of this one, honestly. There may be some headlines for a while, but I imagine the claims end up either being baseless or, if legitimate, an out-of-court settlement complete with a rigid confidentiality agreement will result. Either way, nothing major coming out of either of those two end scenarios. But it's a slow news day, and frankly nothing else is going on, so I'll put it up here.
I will say two more things on the subject, to close: (1) If Ramsey ever gets a dime, he ought to send Glen Dorsey at least half of it, and (2) Auburn should really stop recruiting players named Ramsey.

I've had issues w/
Au’s training staff for sometime. Whether it has been player’s who come back from injury only to find themselves hurt in little to no time or it’s linemen who are in such bad shape they cant do their job so they resort to jumping off or holding.
What happened to Ramsey is a shame, the fact that Goodlett reacted the way he did shows something was amiss. Ramsey worked his ass off and what did he get in return? Abox with all his shit in it. Nall took a situation that was bad and made it worse by 1)having his head too far up his own ass to kno what was going on and b)not explaining to Ramsey what his intent was. Nall and AU blew it on this one.

Don’t know much about it (aside from what was in the article), but I definitely get a “spoiled child” vibe off of Ramsey.
That said, I’ll be really interested to see what the basis for the suit is — I can’t really come up with anything compelling from the article.

… thatt he will be suing with the a malpractice claim against Auburn’s doctors, claiming damages to be him missing out on the rest of his collegiate career, and the chance for a big-time payday in the NFL one day.
Seems like it would be a longshot, though. Like I said earlier, I don’t think anyone will either really come of this, sans a few headlines.

Ignoring the liability and immunity issues,
I’d think damages from a future NFL career will be speculative and hard to prove. I Ifhe’s back is really bad, he can get a pretty good award for pain and suffering. Again, this assumes he can show some liability.
I’m curious to see what Ramsey says about the chop block, i.e. was it accidental or did Nall teach it.

… I think the damages from a possible NFL career will be a lost cause. They may be able to prove that he had a good shot at the NFL one day, but AU could easily point to the short length of NFL careers and the highly speculative nature of the claim to reduce the damages almost to nothing, even if Ramsey can win on the claim. It might be like the USFL’s antitrust claim… you win, and then get a dollar in damages.
And honestly, I think he’ll have a tough time getting pain and suffering. To be sure, I’m aware that he suffered plenty of both, but so what? Pain and suffering is part and parcel of being a football player, and you accept that inevitability when you agree to play football. If a player can legitimately win on that claim — without having to prove a higher standard of medical malpractice causing more pain and suffering than should have been the case, given competent medical care and advice — then hell every college football player to ever play the game could sue their former schools.
I’ll be honest, I’m with Pete, I just do not see him getting much from this lawsuit. The only way I can see him cashing in here is if Auburn has a ton of dirty secrets that Ramsey and his legal team will spill in the process of the litigation, and they pay him a lot of money in an out-of-court settlement to shut him up. That’s the only way I can see Ramsey getting a significant payday here.

NHB alluded too, Auburn is immune from lawsuits, is this correct? If so, who would the suit be against? Tuberville? That would be the only justification for using “shockwaves.” Sorry I’m still not over it…

His lawyer said on JOX this morning that they are suing Nall and another trainer for compensatory damages as he could have played in the NFL, was All-SEC as a freshman, etc. He also said they will go after Tubbs if they find out he might have given orders for him to train during his surgery rehab.
The surgeon that worked on Ramsey said he has never had anything go wrong with that type of surgery and Ramsey would be playing if the they had not pushed him to train. And other players overheard the trainers telling him to “man-up” if he wanted to play and remain on scholarship. Seems like a decent case.

I’m not buying it.
Your doctor says for you to do one thing, some guy who’s never attended medical school tells you to do something else . . . and you listen to the guy without the M.D. behind his name? Yeah, no. That’s just stupid.
It might not be terribly difficult to establish a duty of care between the trainer and the player, but you then have to prove that the course of action the trainer recommended couldn’t have had the desired outcome.

I think you nailed it with that one. He’ll never actually win before a judge and a jury (at least not enough in damages to justify the legal expenses and time of pursuing it), but hell it doesn’t take anything to create an issue of material fact and survive a motion for summary judgment, so damn near anything is going to make it to trial. I’d bet good many there’s a great chance he’ll be next in line for the AU buyouts to keep his mouth shut, right up there with Bowden, Oliver, and Tubby. And, well, if that’s the case, you at least have to give him credit for knowing the operation down that way and having the balls to call them on it to make some money.

True but the guy with the M.D. isn’t threatening you with (no) playing time. The coaches are supposed to follow what the trainers/doctors say, but if this didn’t happen, I can see where Ramsey is coming from.

Bottom line is still that he made a conscious choice to sacrifice his personal well-being to try to get playing time, and now he wants to blame someone else for that decision.
If the trainers were telling him to ‘roid up, and his doctor said not to, would we have the same level of sympathy if he did? It’s basically the same thing.

I thought the coaches were not supposed to be involved in the workouts and weightlifting during may-june-july?
