Among the specific targets: anyone who "seeks to obtain any type of financial gain or benefit from securing a prospective student-athlete's enrollment at an educational institution or a from a student-athlete's potential earnings as a professional athlete."

Such activity by an agent would render the athlete ineligible.

Never mind the "Is it a loophole?" argument- thanks to Cecil Newton, the NCAA has created the rule that many of us feared they would. Want to make a star recruit ineligible at a rival school? Go to that school and try to sell his services there. By this definition you just became a sports agent acting on his behalf. I can't imagine this being a problem.
